THIS DEED OF GIFT is made at Mumbai on this ____ day of __________, 200_ BETWEEN : _________________________, Indian Inhabitant, residing at ____, ________________________________________________, Mumbai - 400 0__, hereinafter called “THE DONOR” (which expression shall unless it be repugnant to the context or meaning thereof include his/her heirs, executors and administrators) of the ONE PART and _________________________________, Indian Inhabitant, residing at _________________________________________, Mumbai – 400 0__, hereinafter called “THE DONEE” (which expression shall unless it be repugnant to the context or meaning thereof include his/her heirs, executors and administrators) of the OTHER PART.
WHEREAS :
i) The Donor is a member of the ____________ Co-operative Housing Society Limited, hereinafter referred to as the “said Society” and an allottee of flat No.___, on the ____ floor of the building named as ___________ of ______________ Co-operative Housing Society Ltd., Mumbai – 400 0__, (hereinafter referred to as the “said Flat”). The said Society has issued 5 (five) fully paid up shares bearing distinctive Nos.___ to ___ as per Share Certificate No.___ dated __-__-19__ (hereinafter referred to as the "said Shares") to the Donor of the First Part.
ii) The Donee is _______________ of the Donor.
iii) The Donor out of natural love and affection for the Donee is desirous of gifting the said flat and the said shares more particularly described in the schedule hereunder written.
iv) The Donee has accepted the gift of the said flat and the said shares from the Donor.
NOW THIS DEED WITNESSETH AS FOLLOWS :
1. The Donor out of natural love and affection for the Donee hereby transfer by way of gift to the Donee, his right, title and interest in the said Shares being 5 (five) fully paid up shares of Rs.50/- (Rupees Fifty Only) bearing distinctive Nos.___ to ___ (both inclusive) as per Share Certificate No.___ dated __-__-19__ of the ____ Co-operative Housing Society Ltd., and Flat No.___ admeasuring ____ sq. ft., carpet area on the ____ floor in the building known as ________ situated at Plot No._____, __________ _______________________________________, Mumbai - 400 0__ more particularly described in the Schedule hereunder absolutely for ever.
2. The Donee has accepted the gift as aforesaid.
